Dermot has over 10 years experience acting as Mediator or mediator advocate; and has been involved in many disputes (70+) over that time. This is in addition to Dermot’s 20 plus years experience acting as a commercial litigator. When acting as mediator Dermot is always conscious of the need to rely upon his core professional skills acquired as a litigator and the need to marry these skills with facilitative tools acquired as a mediator. He has found this an effective recipe to maximising the road to a successful outcome to mediation and commercial compromise.Dermot is an accredited CEDR mediator since January 2003. He is an active Council member of the ICMA. Dermot is also a former member of the Law Society of Ireland’s Arbitration and Mediation Committee, and of the Litigation Committee. Dermot also participated on a 2009 Litigation Task Force established by the Law Society of Ireland to examine the remit of mediation, arbitration and litigation in Ireland. Dermot has been a co-author and sub-committee participant (for the Law Society) on a Report commissioned to look at the existing rules in dispute resolution for Electronic Discovery in the Irish Courts. Dermot is also an active speaker and regularly publishes articles on mediation.

David is an accredited mediator (CEDR) and a chartered accountant. He is treasurer of ICMA and leads a task force whose aim is to expand the use commercial mediation in the public sector. David is also a mentor/ advisor to Enterprise Ireland and a Council member of Gerson Lehrman Group. His background is in financial services where he gained experience of leading large scale change programmes.
Killian is an experienced solicitor who represents clients in the commercial, insurance, retail and aviation sectors. He specialises in the resolution of commercial disputes and has significant experience in commercial litigation and property related cases. Killian regularly represents clients at all Court levels and before employment tribunals & forums. He frequently advises insurers and self-insured commercial organisations with regard to litigation and employment matters. He has extensive experience in providing advice on insurance coverage and pre-litigation exposures. Killian is a CEDR Accredited Mediator and has an active interest in mediation as an alternative to litigation.
Austin has been Chairman of ICMA since 2010. He has been a keen advocate and promoter of mediation since becoming a CEDR accredited mediator in 2004. He has presented extensively on mediation both to the legal community and the wider business community. With an accounting and business background, he sees the tremendous value that mediation brings to dispute resolution.
Ciarán Breen was appointed Director of the State Claims Agency (SCA) in 2007. He joined the NTMA in 2001 when he was appointed Head of Claims at the SCA. Prior to joining the NTMA, he held the position of Managing Director of a leading nationwide firm of insurance liability adjusters. He is a graduate of Maynooth College and the Honorable Society of King’s Inn.
John Madden (Civil Engineer / Solicitor) is an Accredited Mediator having trained with CEDR and Harvard and has conducted over 100 mediations over the past 20 years. His mediation practice is focused on Engineering, Architectural and Construction disputes and he enjoys a long record of success in Ireland and internationally.
David Nolan was born 4 December 1959 in Dublin and was educated at Gonzaga College, Dublin. He graduated from UCD having completed a B Comm. Degree in 1981 and has a Diploma in Anglo Irish Literature from TCD. In 1985 he was called to The Bar and practiced as a Junior Counsel in Dublin for eighteen years, working in the areas of Personal Injury, Insurance, Non-Jury and Commercial Law.
He was called to the Inner Bar in 2003 and in 2005 was elected to the Bar Council. He has served as Chairman of many Committees. In 2009 he was elected Vice Chairman of The Bar Council and in 2010 its Hon. Secretary.
In 2006 he was made a Council Member of the Honourable Society of The Kings Inns and has been a Member of its Education Committee since.
He is a CEDR Accredited Mediator and in 2009 was elected to the Council of the Irish Commercial Mediation Association (ICMA).
David is the Chairman of The Bar Council of Ireland and is a Member of the Judicial Appointments Advisory Board, the Advisory Committee on Applications to take Silk in Ireland, the IBA International Bar Association and the CCBE the European Bar Association and the Courts Service of Ireland.
In November 2013 David took the Call to the English Bar and was elected a Bencher of the Kings Inns in December 2013.
Breda O’ Malley
Breda is a Solicitor with a particular expertise in employment law, advising both employers and employees on all aspects of the employment relationship. Breda proactively works to resolve employment disputes in a conciliatory manner where feasible. She advises senior management teams in businesses across a range of sectors including retail, logistics, aviation and others. Breda also has a wide range of experience in dealing with commercial disputes, with a focus on resolving them at the earliest stage possible. Her commercial litigation experience extends across the range of civil courts. She has extensive experience drafting and negotiating commercial contracts at the different levels of the business supply chain.
Michael is a Fellow of the Institute of Chartered Accountants and is Managing Director of Madigan Mediation & Consultancy Services Limited. Michael is also a non-executive Director of 15 other companies. Michael has 29 years banking experience having held senior risk and lending positions with Ulster Bank and First Active.
Gavin is a qualified solicitor and a partner in the Litigation and Dispute Resolution Group of Arthur Cox. He advises clients in a wide range of contentious matters including commercial and civil litigation before the Courts and has been involved in domestic and international arbitration. Gavin has a particular interest in mediation and has given talks on his experience of mediation as a practitioner.
Joanne is Head of Legal for Bord Gais Energy responsible for managing a team of lawyers who support the integrated energy business. She began her career in a leading Irish firm where she worked primarily in M & A. Since 2004 she has held a number of Head of Legal & Company Secretary roles in the IT, FMCG and Energy sectors (most recently as Head of Legal for Coca-Cola Hellenic).
David leads the Forensic group in Deloitte Ireland, where services provided include litigation support, expert witness, alternative dispute resolution, financial and fraud investigations and business intelligence services including asset tracing.
In addition to forensic, David has a wide range of corporate finance experience including M&A Transaction Services, valuations, Restructuring and insolvency. He has acted as an independent expert in a variety of commercial disputes involving valuations, share purchase agreements, breach of contract and shareholder disputes. David has been involved in a number of investigations, including fraud investigations.
He has experience in property and construction, hotels and leisure, financial services, media, telecoms, waste, energy, retail manufacturing, distribution and food sectors.
David’s client portfolio includes a large range of publicly quoted companies, state bodies, and large corporate clients both in Ireland and internationally.
David is a Fellow of Chartered Accountants Ireland and a member of the Irish Society of Insolvency Practitioners, INSOL Europe and an Associate Member of the Association of Business Recovery Professionals – R3. He holds a LLB Honours Degree in Law from Queens University and a Professional Diploma in Accounting from Dublin City University.
